These Terms and Conditions apply to the use of the Nelleke de Vries website, newsletter, public archive pages, pre launch access forms, paid member access, digital documentary content and related online services.
Please read these Terms carefully before using the website, subscribing to the newsletter or purchasing member access.
By using this website, subscribing to updates or purchasing paid access, you agree to these Terms.
1. About Nelleke de Vries
Nelleke de Vries is a documentary and digital media project connected to the archive of a civilian mission in Ukraine.
The website publishes public information, selected images, video fragments, mission related stories, newsletter updates and, after launch, members only documentary chapters.

2. Definitions
Website means the website operated under the domain nellekedevries.com.
Archive means the public and protected documentary material connected to the Nelleke de Vries mission archive.
Public content means content available without paid access.
Members only content means digital content available only to paid members or approved users.
Member means a person who has purchased or received access to the members only documentary series.
Newsletter means email updates sent by Nelleke de Vries.
User means any visitor, subscriber, customer or member who uses the website or related services.
Digital content means online text, images, videos, documents, archive material, updates and documentary chapters delivered through the website or related services.

4. Nature of the project
Nelleke de Vries publishes documentary stories and archive material related to a civilian mission in Ukraine.
The content may include public stories, selected images, selected video material, mission reflections, field context, home front stories, protected archive notes and members only documentary chapters.
The project is not a news agency, emergency service, military instruction platform, medical service, legal advisory service or intelligence source.
The content is provided for documentary, educational, historical, narrative and informational purposes.
5. Public content
Public content may be viewed without paid access.
Public content may include articles, images, videos, newsletters, previews, launch information, public archive fragments and general project information.
Public content may be changed, edited, removed, delayed or updated at any time.
We may withhold or remove content when needed for safety, privacy, legal, ethical, editorial or security reasons.
6. Newsletter
Users may subscribe to the Nelleke de Vries newsletter.
The newsletter may include:
Mission archive updates
Publication announcements
Pre launch access information
Members only access information
YouTube and video updates
Public story updates
Paid membership announcements
Safety and archive related information
Subscription to the newsletter is voluntary.
Users can unsubscribe at any time using the unsubscribe link in the newsletter or by contacting us.
Newsletter subscription does not create paid membership.
Newsletter subscription does not guarantee access to members only content.
7. Paid member access
After launch, Nelleke de Vries may offer paid access to members only documentary content.
Paid member access may include:
Long form documentary chapters
Protected context behind images and videos
Archive based stories
Mission reflections
Home front chapters
Selected background documentation
Publication updates
Members only newsletters or notices
Access to paid content is provided only after successful payment or approved access.
The exact content, price, duration, renewal rules and access conditions will be shown before purchase.
8. Account access
Members may be required to create an account or use a login to access members only content.
Members are responsible for keeping login details private and secure.
Members may not share login details with other people.
Members may not resell, transfer, publish or distribute their access.
If we suspect account sharing, abuse, fraud, security risk or violation of these Terms, we may suspend or terminate access.
9. Payment
Prices will be shown clearly before purchase.
Prices may be shown as monthly, annual, one time, founding member or other membership options.
Payment must be completed through the payment methods offered on the website or through the payment provider.
Access may be delayed, suspended or refused if payment fails, is reversed, disputed or fraudulent.
Nelleke de Vries does not intentionally store full payment card details on its own website. Payment providers process payment details according to their own terms, privacy policies and security obligations.
10. Taxes
Prices may include or exclude VAT depending on the offer, customer location, tax status and applicable law.
If VAT applies, it will be handled according to applicable Dutch and European tax rules.
Invoices or payment confirmations may be issued where required.
11. Subscription duration and renewal
The duration of any paid membership will be stated before purchase.
A membership may be offered as monthly access, annual access, founding member access or another clearly described access model.
If a membership renews automatically, this will be shown before purchase.
Members can cancel according to the cancellation instructions shown on the website or in the account environment.
Cancellation stops future renewal where applicable. It does not automatically refund amounts already paid, unless required by law or stated in the offer.
12. Cancellation by the member
Members can cancel future access or renewal according to the cancellation method provided on the website, payment platform or account environment.
If the website offers a cancellation button or online cancellation method, members should use that method.
A member may also contact us by email if the cancellation method is not available.

13. Right of withdrawal
Consumers may have a statutory right of withdrawal for online purchases under applicable consumer law.
For many online purchases, the withdrawal period is 14 days.
For paid digital content or digital services, special rules may apply.
If a consumer purchases digital content and requests immediate access during the withdrawal period, the consumer may lose the right of withdrawal once access to the digital content starts, where permitted by law.
Before immediate access is provided, the consumer may be asked to confirm:
That they request immediate access to the digital content.
That they understand the statutory right of withdrawal may end once access begins, where permitted by law.
If this confirmation is not given, access may be delayed until the withdrawal period has expired.

15. Refunds
Refunds are handled according to applicable law, the type of purchase, the access status and the terms shown before purchase.
If a consumer validly exercises the right of withdrawal before access to digital content has started, we will refund the applicable payment according to the law.
If the consumer requested immediate access and acknowledged that the right of withdrawal may end once access begins, refunds may not be available after access starts, where permitted by law.
Refunds may be refused in cases of fraud, misuse, chargeback abuse, unauthorized account sharing or violation of these Terms.
16. Availability of content
We aim to keep the website and members only content available, but we do not guarantee uninterrupted access.
Access may be interrupted due to maintenance, technical issues, hosting issues, security concerns, payment provider issues, legal reasons, content review or circumstances beyond our control.
We may update, replace, remove, delay or restrict content when needed for safety, privacy, security, legal, ethical, editorial or operational reasons.
17. Archive safety and protected material
The Nelleke de Vries archive may involve sensitive situations, protected people, mission related material, locations, vulnerable persons and events connected to war.
Not all archive material can be public.
Not all archive material can be released immediately.

Published only behind member access
We may protect names, faces, locations, operational details, private addresses, medical details, children, vulnerable people and other sensitive information.
No user or member has a right to demand publication of protected archive material.
18. No operational or tactical use
The content is not intended for operational, military, tactical, targeting, intelligence, surveillance, legal, medical or emergency use.
Users must not use the website, archive, images, videos or stories to identify protected persons, expose private locations, create risk, harass people, spread doxxing information, support violence or misuse mission related material.
Any attempt to misuse the archive may lead to blocked access, removal from the platform, legal action or reporting to relevant authorities.
19. Intellectual property
All website content, archive texts, images, videos, designs, logos, names, documentary chapters, written material and related publications are protected by intellectual property rights unless stated otherwise.
Users may view public content for personal, non commercial use.
Members may view members only content for personal, non commercial use during their active membership.
Users and members may not copy, reproduce, download, publish, distribute, sell, scrape, modify, translate, archive, reupload, train AI systems on, commercially exploit or publicly display the content without written permission.
Screenshots, screen recordings, copying members only text, reposting protected content or sharing members only material outside the platform is not allowed.
20. Limited sharing
Users may share public website links.
Users may not share members only content itself.
Users may not remove credits, watermarks, safety edits, context notes or copyright notices.
Users may not present Nelleke de Vries content as their own work.
21. User submitted material
If users send messages, documents, images, video, testimony, corrections or other material to Nelleke de Vries, they confirm that they have the right to send that material.
Sending material does not guarantee publication.
We may review, edit, reject, remove or archive submitted material.
Users should not send highly sensitive material through public website forms.
Users should not send national identification numbers, BSN numbers, passport numbers, classified information, private medical data, operational details, private addresses or content that could endanger people.
22. Privacy and data
Personal data is handled according to the Data Policy and Privacy Policy available on the website.
The Data Policy explains how newsletter data, website data, account data, payment related data and archive related data may be handled.
Users must read the Data Policy before subscribing, contacting us or purchasing access.
23. Conduct rules

Upload malware
Send threats
Harass protected people
Attempt to identify or expose protected persons

24. Comments, reviews and public interaction
If the website allows comments, reviews or user interaction in the future, users must communicate respectfully and lawfully.
We may remove comments, reviews or messages that are unlawful, abusive, misleading, defamatory, threatening, unsafe, privacy invasive, spam based or unrelated to the project.
We may disclose whether reviews are verified or unverified if reviews are used for commercial presentation.

External websites and platforms are controlled by their own operators.
Nelleke de Vries is not responsible for external websites, third party content, third party privacy practices, platform outages or changes made by third party services.
26. YouTube and public video content
Nelleke de Vries may publish public video fragments on YouTube or other platforms.
Public video content may serve as an entry point to the archive.
The deeper documentary context may be available only through the website, newsletter or members only channel.
Public video publication does not mean all related archive material is public.
27. Changes to content and services
We may change the website, archive, newsletter, membership structure, pricing, content schedule, publication format, access model or available features.
If major changes affect paid members, we will take reasonable steps to inform affected members.
28. No guarantee of specific publication schedule
The archive may be published step by step.
Publication may depend on safety checks, privacy review, editorial work, legal concerns, translation, technical availability, member access systems and protection of people involved.
We do not guarantee that a specific chapter, image, video or story will be published on a specific date unless this is expressly confirmed in writing.
29. Liability
The website and content are provided with care, but errors, delays, omissions or technical issues may occur.
To the maximum extent permitted by law, Nelleke de Vries is not liable for indirect damage, loss of data, loss of profit, business interruption, reputational damage, third party platform issues or misuse of content by others.
Nothing in these Terms excludes liability where exclusion is not permitted by law.
30. Force majeure
Nelleke de Vries is not liable for delay or failure caused by circumstances beyond reasonable control, including technical outages, cyber incidents, hosting failure, payment provider failure, war related circumstances, legal restrictions, illness, platform changes, power failure, government action, natural disasters or other force majeure events.
31. Suspension and termination
We may suspend or terminate access if:
Payment fails
A user violates these Terms
A user shares members only content
A user creates safety or privacy risks
A user abuses the website or contact channels
A user attempts unauthorized access
A legal or security reason requires suspension
Termination does not automatically create a refund right unless required by law or stated in the offer.

If no solution is reached, disputes may be submitted to the competent court in the Netherlands, unless mandatory consumer law gives the consumer the right to bring a claim elsewhere.

We may update these Terms when the website, business registration, membership model, payment model, legal requirements, services or archive publication process changes.
The latest version will be published on this page.
For paid members, the version available at the time of purchase applies unless a later change is required by law or is reasonably necessary for safety, security, operation or legal compliance.
